Creator Guidelines

1. About UltCast

UltCast Pty Ltd ("UltCast", "we", "us", or "our") operates a live audio marketplace at ultcast.live (the "Platform"). The Platform enables registered users ("Creators") to broadcast live audio commentary on sporting events, and other registered users ("Listeners") to discover and listen to those broadcasts. UltCast also facilitates a voluntary tipping system through which Listeners may send monetary tips directly to Creators.

These Terms of Service ("Terms") govern your access to and use of the Platform. By registering an account or using any part of the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.


2. Eligibility

You must be at least 18 years of age to create an account and use the Platform. By registering, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.

UltCast is currently available in Australia. If you access the Platform from outside Australia, you do so at your own risk and are responsible for compliance with local laws.


3. Accounts

To use the Platform you must register an account with a valid email address and a unique username. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must not create an account using false information, impersonate another person, or create multiple accounts for deceptive purposes. UltCast reserves the right to suspend or terminate accounts that breach these Terms.


4. The Tipping System

UltCast operates a voluntary tipping model. Listeners may choose to send a monetary tip to a Creator during or after a live broadcast. Tips are processed through Stripe, a third-party payment processor. By making or receiving a tip, you also agree to Stripe's Terms of Service.

UltCast deducts a platform fee of 20–30% from each tip before the remainder is disbursed to the Creator. Tips are non-refundable except in cases of fraud or processing error as determined by UltCast in its sole discretion.

UltCast does not guarantee a minimum income to any Creator. The receipt of tips is voluntary and depends entirely on Listener choice.


5. User-Generated Content

Creators are solely responsible for all audio content they broadcast through the Platform ("Creator Content"). UltCast operates as a user-generated content platform and does not pre-screen broadcasts. By broadcasting on UltCast, you represent and warrant that your Creator Content:

Creator Liability: You indemnify UltCast, its officers, directors, employees, and agents against any claim, liability, damage, loss, or expense arising from your Creator Content or your breach of these Terms.


6. Broadcasting Rights & Copyright

Sports events and the factual information within them (scores, player names, match results) are public information and cannot be copyrighted. However, the official broadcast of a sporting event — including its audio commentary, video footage, studio segments, and replays — is protected by copyright and broadcast rights held by leagues, broadcasters, and rights-holders.

UltCast's platform is built on the principle of transformative, non-substitutive commentary. This means:

The Replicate Experience Test: If your audio could be swapped with an official radio broadcast and a listener would have the same understanding of every moment of the game, your commentary is not permitted on UltCast. Continuous, moment-accurate play-by-play that reconstructs the broadcast requires a broadcasting licence and is prohibited on this platform.

UltCast reserves the right to remove any broadcast that it reasonably believes infringes third-party rights. Repeat offenders will be permanently banned from the Platform.


7. Trademarks & Official Affiliation

You may refer to factual information such as team names, competition names, and match results. You must not use protected logos, imply any official affiliation with any sports league, club, broadcaster, or sponsor, or present your UltCast as an officially endorsed broadcast. If you include advertising, sponsorships, or paid promotions in your broadcasts, you must ensure they do not conflict with exclusive sponsorship categories held by leagues or broadcasters.


8. Defamation & On-Air Conduct

Australian defamation law is strict and athlete-protective. Commentary that includes false statements of fact about players, officials, coaches, or other individuals — including speculation about injuries, private conduct, or off-field matters — may expose you to legal liability. UltCast may remove content and cooperate with any defamation complaint or legal process.

You must not broadcast content that is discriminatory, vilifying, sexually explicit, or designed to harass any individual.


9. Moderation & Enforcement

UltCast operates a strike-based enforcement system. Breaches of these Terms or the Creator Guidelines may result in:

  1. A formal warning;
  2. Temporary suspension of broadcasting privileges;
  3. Permanent account termination.

UltCast will respond to takedown requests from rights-holders, regulatory bodies, and law enforcement in accordance with applicable Australian law.


10. Platform Availability

UltCast is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access to the Platform and are not liable for any loss resulting from downtime, technical failure, or service interruption. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time.


11. Limitation of Liability

To the maximum extent permitted by Australian law, UltCast's total liability to you for any claim arising out of or relating to these Terms or the Platform is limited to the amount of fees you have paid to UltCast in the 12 months preceding the claim, or AUD $100, whichever is greater. UltCast is not liable for any indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited by contract.


12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Platform or emailing your registered address. Continued use of the Platform after notice constitutes your acceptance of the updated Terms.


13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

UltCast Pty Ltd ("UltCast", "we", "us") is committed to protecting your personal information. This Privacy Policy explains what information we collect, how we use it, who we share it with, and your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

4. Third-Party Services

UltCast uses the following third-party services to operate the Platform:

Supabase — database and authentication. Your account data, profile information, and cast records are stored in Supabase's infrastructure hosted in Singapore (Southeast Asia). Supabase complies with SOC 2 Type II standards.

LiveKit — real-time audio streaming infrastructure. Your audio broadcasts are transmitted through LiveKit's servers. LiveKit processes audio in real time and does not retain recordings beyond the duration of a session unless a recording feature is explicitly activated.

Stripe — payment processing. Tips you send or receive are processed by Stripe. Stripe is PCI DSS compliant. UltCast never has access to your full card number. By making a payment you agree to Stripe's Terms of Service.

Vercel — serverless infrastructure for token generation and API services. No personal data is stored on Vercel beyond transient request logs.

We may also use analytics tools to understand Platform usage. Any such data is aggregated and de-identified.


5. Information We Share

We do not sell your personal information. We share it only in the following circumstances:

Your display name, username, bio, profile photo, and broadcast history are visible to other users of the Platform. Your email address is never made public. Listener counts and tips received by Creators may be displayed publicly on the Platform.


7. Data Retention

We retain your account information for as long as your account is active. If you delete your account, we will delete your personal information within 30 days, subject to any legal obligations that require us to retain it for longer (such as financial records related to tips, which we retain for 7 years as required under Australian tax law).


8. Security

We take reasonable steps to protect your information from unauthorised access, loss, misuse, and disclosure. These include encryption in transit (HTTPS), secure authentication (Supabase Auth), and access controls. However, no system is completely secure and we cannot guarantee absolute security.

If you become aware of any breach of your account security, please notify us immediately at security@ultcast.live.


9. Your Rights

Under the Australian Privacy Principles, you have the right to:

10. Cookies

UltCast uses session tokens (stored in your browser's local storage) to maintain your logged-in state. We do not use third-party advertising cookies. You may clear your browser's local storage at any time, which will log you out of the Platform.


11. Children's Privacy

The Platform is not directed at individuals under 18 years of age. We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected such information, we will delete it promptly.


12. International Users

If you access the Platform from outside Australia, your information may be transferred to and processed in Australia and other countries where our service providers operate (including Singapore and the United States). By using the Platform you consent to such transfers.


13. Changes to This Policy

We may update this Privacy Policy periodically. We will notify you of material changes via the Platform or email. The effective date at the top of this page will always reflect the most recent version.

UltCast exists because sports fans deserve more than the same polished, corporate commentary on repeat. You're here to add something new — your voice, your take, your personality. These guidelines exist not to limit you, but to protect you and ensure UltCast remains a sustainable, legal platform for everyone.


1. The Golden Rule — Transformative Commentary

The most important principle on UltCast is this: your commentary must be transformative, not substitutive.

A transformative cast adds something new — your personality, analysis, humour, reactions, or unique perspective. It does not reconstruct the official broadcast. A listener to your cast should need legitimate access to the official broadcast to follow the game. You are their companion, not their broadcaster.

The Replicate Experience Test: Ask yourself — if someone listened only to your cast, would they have the same understanding of every moment of the game as if they were listening to official radio commentary? If yes, your cast is not permitted on UltCast. Continuous play-by-play that describes every moment as it happens, from start to finish, requires a broadcasting licence. It is not allowed here.

Tips sent to you by Listeners are processed via Stripe. UltCast deducts a platform fee of 20–30% before disbursing the remainder to you. You are responsible for declaring any income you receive through tips for tax purposes in accordance with Australian tax law. UltCast does not provide tax advice.


6. Enforcement

UltCast monitors content through a combination of user reports and active moderation. Violations of these guidelines may result in:

  1. A formal warning and content removal;
  2. Temporary suspension of your broadcasting privileges;
  3. Permanent account ban for serious or repeat violations.

If you receive a takedown request or legal notice relating to your cast, notify us immediately at legal@ultcast.live.


7. Your Responsibility

By broadcasting on UltCast, you take full legal responsibility for your content. You indemnify UltCast against any claim arising from your broadcasts. UltCast provides the platform — you own what you say.

In plain English: Be yourself. Add value. Don't reproduce the broadcast. Don't pretend to be official. Don't defame anyone. Everything else is fair game — that's what UltCast is for.
